These Terms set out the agreement between you and Nest. Please read them carefully — by creating an account or using the App, you're agreeing to everything below.
These Terms of Service ("Terms") govern your use of the Nest mobile application ("Nest", the "App"), provided by Nest - Family Management ("we", "us", "our"). By creating an account or using Nest, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Nest.
You must be at least 18 years old to create a Nest account. By creating an account, you confirm that you are 18 or older and that the information you provide is accurate. If you add other people to a family group, you confirm that you have the authority to do so and that you are responsible for their use of the App.
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Please notify us promptly at [email protected] if you suspect any unauthorized use. We are not liable for losses arising from unauthorized use of your account where you have not kept your credentials secure.
Nest helps families coordinate through shared features including a notice board, calendar, reminders, shopping lists, expense splitting, and birthday tracking. We may add, change, or remove features over time.
Within a family group, members can view and edit shared content. Family administrators can approve join requests, change member roles, and remove members. Removing a member — or being removed — may affect access to shared content.
Nest offers a free tier and an optional paid premium subscription.
Free tier. The free tier supports families of up to three members, with some features limited.
Premium subscription. A premium subscription unlocks larger family groups and additional functionality. Premium is offered as a recurring subscription billed through the Apple App Store or Google Play.
Billing and auto-renewal. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the period ends. Payment is charged to your Apple or Google account. Your subscription, including renewal and cancellation, is managed through your App Store or Google Play account settings — not through us.
Free trial. If a free trial is offered, any unused portion is forfeited when you purchase a subscription. If you do not cancel before the trial ends, you will be charged for the subscription.
Price changes. We may change subscription prices. Changes apply to future billing periods, and we will provide notice as required by the app stores and applicable law.
Refunds. Purchases are processed by Apple or Google, and refunds are subject to their policies. We generally cannot issue refunds directly; refund requests should be made to the App Store or Google Play.
You agree not to:
You retain ownership of the content you create in Nest. You grant us a limited licence to store, process, and display that content as needed to operate the App and provide the service to you and your family group. You are responsible for the content you add and confirm that you have the right to add it.
You may stop using Nest and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the App in a way that harms other users or us. On termination, your right to use the App ends; provisions that by their nature should survive — such as disclaimers and limitation of liability — will continue to apply.
Nest is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure. Reminders and notifications are provided as a convenience and should not be relied upon for critical or time-sensitive matters.
To the maximum extent permitted by law, Nest - Family Management will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use Nest. To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the twelve months before the claim, or ten Canadian dollars (CAD 10).
You agree to indemnify and hold harmless Nest - Family Management from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the App or your violation of these Terms.
Your use of Nest is also subject to the terms of the app store from which you downloaded it (the Apple App Store or Google Play). This agreement is between you and Nest - Family Management only — not with Apple or Google — and Apple and Google are not responsible for the App or its content. Where you obtained the App from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the App. Your continued use of Nest after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles. Any disputes will be subject to the courts located in Ontario, Canada, unless applicable law requires otherwise.
